Legal Advisory – Prague

We offer free legal counseling to foreigners legally residing in the Czech Republic.

Legal counseling is provided as part of a registered social service, Professional Social Counseling, in accordance with Act No. 108/2006 Coll. on Social Services, as well as through individual projects.

Legal counseling is available in the following legal areas: 

• Immigration Law: information on various residence permits under Act No. 326/1999 Coll. on the Residence of Foreigners in the Czech Republic and related matters. This includes situations such as:
  • A foreigner receives a request to correct defects in an application for a new residence permit or an extension of an existing permit
  • A foreigner receives a request to review supporting documents before a decision is made
  • A foreigner is considering applying for permanent residence (after five years of residence in the Czech Republic; in exceptional cases, earlier)
  • A foreigner is changing the purpose of stay
  • A foreigner has initiated administrative proceedings with an application, and the authority is inactive
  • A foreigner receives notice of the initiation of proceedings for the cancellation of a residence permit
  • A foreigner receives a decision rejecting an appeal and is considering filing a lawsuit
  • A foreigner with temporary residence as a family member of an EU citizen is considering initiating divorce proceedings 

• Rights and obligations of asylum seekers and individuals granted subsidiary protection, particularly regarding legal advice for the extension of subsidiary protection
• Rights and obligations of foreigners under Act No. 65/2022 Coll. on Certain Measures in Connection with the Armed Conflict in Ukraine triggered by the Russian Federation’s invasion. This includes:
  • A foreigner considering applying for temporary protection
  • A foreigner who submitted a temporary protection application that was deemed inadmissible
  • A foreigner who received notice of the initiation of proceedings to withdraw temporary protection

• Acquisition of Czech citizenship, for example:
  • A foreigner considering applying for Czech citizenship
  • A foreigner initiated administrative proceedings by submitting an application, and the authority is inactive
  • A foreigner receives a request to correct defects in the application

• Basic legal counseling in civil law areas such as:
  • Tenancy (lease agreement review, disputes with landlords)
  • Debt recovery (pre-litigation notices, in exceptional cases drafting lawsuits, preparing enforcement proposals with a lawyer’s agreement)
  • Defense against an insurance company’s resolution of a damage event

• Basic legal counseling in family law (e.g., drafting proposals for child custody and alimony, divorce proceedings, paternity determination, increasing alimony, alimony enforcement)
• Basic legal counseling in administrative offenses or criminal law (where a foreigner is a victim, witness, or accused), for example:
  • Drafting criminal complaints in justified cases (especially for neglect of mandatory maintenance or fraud)
  • Filing requests for access to the case file, appeals, or statements

• Basic legal counseling in social security law (e.g., appealing against a decision of an administrative authority)
• Basic legal consultation in labor law (e.g., cases such as:
  • A foreigner is entitled to a claim against an employer
  • A foreigner is considering terminating employment
  • A foreigner’s employment ended unlawfully
  • A foreigner did not receive a certificate of employment or pay slips after employment ended)

• Basic legal counseling in association law, for example:
  • A foreigner is considering founding an association
  • A foreigner submitted a faulty proposal for the initial registration or change of registered data with the Commercial Register

 

What should I do if I need legal assistance?

Appointments are required for every consultation and can be scheduled by phone, email, or in person at the appropriate office.

 

How does a consultation with a lawyer work?

Consultations take place in person. However, after prior arrangement, consultations can also be provided by phone, online, or via email.

 

In addition to individual consultations, legal assistance may include drafting relevant submissions (applications, appeals, statements, lawsuits, complaints, and other documents), communication with authorities and third parties, and, in justified cases, representation of selected clients in administrative proceedings.
